Terms of Service
The rules for using this website. The terms of an actual engagement live in the proposal and agreement we sign with you — this page covers the Site itself.
These are working terms provided as a starting point. They should be reviewed by a qualified attorney and adapted to your actual practices and the laws of your jurisdiction before being relied upon. Until that review, treat this as informational. Nothing here overrides the specific written agreement governing a paid engagement.
These Terms of Service (“Terms”) govern your use of webdesignintampafl.us.com (the “Site”), operated by Web Design in Tampa FL (“we,” “us,” “our”). By accessing or using the Site, you agree to these Terms. If you don’t agree, please don’t use the Site.
1. Who we are and what this covers
Web Design in Tampa FL is a web-design and SEO agency based in Tampa, Florida. These Terms apply to the public Site — the marketing pages, articles, and contact options. They do not govern paid services: any engagement (an authority-site build, a web-design project, an SEO audit, programmatic SEO, a care plan, etc.) is governed by a separate written proposal and/or service agreement, which controls in the event of any conflict with these Terms.
2. Use of the Site
You may view, download, and print pages of the Site for your own informational and evaluation purposes. You agree not to:
- use the Site for any unlawful purpose or in violation of these Terms;
- copy, scrape, republish, or redistribute substantial portions of the Site’s content for commercial use without our written permission;
- attempt to gain unauthorized access to the Site, its servers, or related systems, or interfere with their operation (including via malware, denial-of-service attempts, or excessive automated requests);
- misrepresent your identity or affiliation, or use the Site to harass, defame, or harm others.
3. Intellectual property
The Site’s content — text, design, code, graphics, the “Web Design in Tampa FL” name and marks, and the underlying systems — is owned by Web Design in Tampa FL or its licensors and is protected by applicable intellectual-property laws. Examples of client work shown on the Site are used with permission or as anonymized illustrations; results described reflect specific situations and are not a promise of similar results for you.
For clients: when we deliver a build, ownership of the final website and the custom theme transfers to you on full payment, as set out in your engagement agreement. The Site’s own content is separate and remains ours.
4. Inquiries and submissions
When you contact us, you’re responsible for the accuracy of what you send and for having the right to share it. We treat inquiries per our Privacy Policy. Sending an inquiry doesn’t create a client relationship — that begins only when we both sign an engagement agreement. Don’t send us confidential or sensitive information in an initial inquiry.
5. No professional advice
Content on the Site — including articles, guides, and audit-related material — is general information about web design and SEO, not legal, financial, or other professional advice, and not a guarantee of rankings, traffic, leads, or revenue. Search engines change; outcomes depend on factors outside our control. Make decisions based on your own circumstances and, where appropriate, professional counsel.
6. Third-party links and tools
The Site may link to or reference third-party websites, products, and services. We don’t control them, don’t endorse them by linking, and aren’t responsible for their content, terms, or practices. Your use of any third-party site or tool is between you and that third party.
7. Disclaimer of warranties
The Site is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don’t warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components, or that any information on it is complete or current.
8. Limitation of liability
To the fullest extent permitted by law, Web Design in Tampa FL and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from or related to your use of (or inability to use) the Site — even if we’ve been advised of the possibility. Where liability cannot be excluded, it is limited to the amount you paid us, if anything, for access to the Site (typically zero). Nothing here limits liability that cannot be limited under applicable law.
9. Indemnification
You agree to indemnify and hold harmless Web Design in Tampa FL from claims, damages, and expenses (including reasonable legal fees) arising out of your misuse of the Site or your violation of these Terms or of any law or third-party right.
10. Changes to the Site and these Terms
We may modify, suspend, or discontinue any part of the Site at any time. We may also update these Terms; when we do, we’ll change the “Last updated” date above. Continued use of the Site after changes means you accept the revised Terms. If you don’t agree, stop using the Site.
11. Governing law
These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules. Any dispute relating to the Site will be brought in the state or federal courts located in Hillsborough County, Florida, and you consent to that jurisdiction — except where applicable law gives you the right to bring a claim elsewhere.
12. Miscellaneous
If any provision of these Terms is held unenforceable, the rest stays in effect. Our failure to enforce a provision isn’t a waiver of it. These Terms, together with the Privacy Policy and any signed engagement agreement, are the entire agreement between you and us regarding the Site.
